Court action against MoJ after "unfair" contract award

According to The Times, the Ministry of Justice (MoJ) is being sued by Mitie, following claims that it lost out on a contract to clean and repair courts and tribunal facilities.

The company had previously provided FM services to court facilities in the South of England, delivering a mix of maintenance, security and cleaning.

According to The Times report, Mitie has lodged a claim for more than £200,000 in damages, with the court case against the MoJ also seen to be carrying a sense of irony due to the subject.

The report said that the company claims the MoJ adopted an "unfair and unequal" approach for the scoring of the tender, resulting in scores being awarded that were "manifestly wrong".

Engie was awarded the cleaning and building repairs contract, as it continues its growth in the public sector, and another demand within the court case is that the deal is annulled.

The government has stated that all EU rules were correctly followed throughout the tendering process and the court case will be "robustly defended".
